Federal judge rules against Kentucky’s Medicaid waiver

On Wednesday, a federal judge ruled to undo approval of Kentucky’s Medicaid waiver.

The federal Centers for Medicare and Medicaid Services (CMS) approved Kentucky’s Section 1115 Medicaid waiver, known as Kentucky HEALTH (Helping to Engage and Achieve Long-Term Health), back in November.

The Bevin administration has stated the goal of Kentucky HEALTH is to improve the health of its participants, strengthen Medicaid’s long-term fiscal sustainability, and promote personal responsibility for health and well-being.

The program was set to begin April 1, 2019, according to guidance by CMS.

The ruling Wednesday by U.S. District Judge James Boasberg blocks Kentucky from implementing the work requirements set forth in the waiver.
